These Terms and Conditions ("Terms") govern your use of the website: www.themuralstory.com for the brand The Mural Story™, trademarked and owned by Ekam Internet LLP (“Company”) a company incorporated under the provisions of the Companies Act, 1956 with its registered office at B4/7A, The Hibiscus, Sector 50, Gurgaon, Haryana - 122018. You may be accessing our Site from a computer or mobile phone device (through an iOS or Android application, for example) and these Terms of Use govern your use of our Site and your conduct, regardless of the means of access. These Terms of Use govern all the products offered on the Site.

1. General Information

The Mural Story specializes in premium customized wallpaper design, manufacturing, and delivery.

1.2. Eligibility:
You must be at least 18 years of age to use this Website and place an order. By using the Website, you represent that you meet this age requirement.

1.3. Modification of Terms:
We reserve the right to update or modify these Terms at any time without prior notice. Changes will be effective immediately upon posting on the Website. Continued use of the Website constitutes acceptance of the revised Terms.

2. Products and Services

2.1. Customization:
All wallpapers are customized according to the specifications provided by you during the ordering process. Please ensure that all customization details are accurate.

2.2. Design and Color Variations:
While we strive to represent designs and colors accurately, slight variations may occur due to monitor settings, lighting conditions, and printing processes.

2.3. Product Care:
Detailed instructions for wallpaper installation and maintenance will be provided. Any damage caused due to improper handling or installation will not be covered under our return policy.

3. Ordering Process

3.1. Order Confirmation:
Upon placing an order, you will receive an email confirming the details of your order. This confirmation does not constitute acceptance of your order, which will be processed once payment is received in full.

3.2. Pricing and Payments:
All prices listed on the Website are in INR and include applicable taxes unless stated otherwise. Payments can be made via the available payment methods listed at checkout.

3.3. Order Cancellations:
Orders can be canceled within 24 hours of placement. Custom orders that are already in production cannot be canceled or refunded.

3.4 TIMELINES AND RESOLUTION

1. Returns for defective products only
- Customers must report the defect within 2 days of delivery
- Required: Photos of the wallpaper for evaluation

- Refund will be initiated within 2 days of successful eligibility for refund and it will take 5-7 days for refund to be credited back to the source of payment - bank account of credit card.

2. No Exchange:
We do not accept Exchange for any purchase.

3. Order Cancellation
- Orders can be cancelled within 24 hours of placement
- Cancellation not available once production begins

4. Non-Delivery Claims
- Submit claims within 7 days of expected delivery date
- Provide order number and delivery address

5. Resolution Process
- Quality verification: 24 hours
- Replacement delivery: Within 2 business days
- Collection of affected wallpaper (if required): Arranged by The Mural Story

4. Returns and Refund Policy

Quality Commitment

At The Mural Story, we are dedicated to delivering exceptional quality. Every wallpaper strip undergoes thorough inspections by our skilled production team to ensure it meets our high standards before leaving our facility.

Important Notes

  • Made-to-Measure Products: Since all wallpapers are custom-made to your wall dimensions, we cannot accept returns for the following reasons:
    • Changes in plans.
    • Post-installation concerns.
    • Incorrect measurements provided by the customer.

5. Intellectual Property

5.1. Ownership:

INTELLECTUAL PROPERTY RIGHTS

The names and logos and all related product names, design marks and slogans are the trademarks, logos or service marks (hereinafter referred to as “Marks”) of the Company. No trademark or service mark license is granted in connection with the materials contained on this Site. Access to this Site does not authorize anyone to use any Marks in any manner. Marks displayed on this Site, whether registered or unregistered, of the Company are the intellectual property of the Company.

The Company expressly and exclusively reserve all the intellectual property rights in all text, programs, products, processes, technology, content, software and other materials, which appear on this Site, including its looks and feel. The compilation (meaning the collection, arrangement and assembly) of the content on the Site is the exclusive property of the Company and are protected by the Indian copyright laws and International treaties. Consequently, the materials on this Site shall not be copied, reproduced, duplicated, republished, downloaded, posted, transmitted, distributed or modified in whole or in part or in any other form whatsoever, except for your personal, non-commercial use only. Intellectual Property – Design Files

All digital files created or worked on by the Company, regardless of their source, shall remain the sole intellectual property of the Company. Under no circumstances shall these digital files be shared with any external party (including the customer). Any employee, contractor, or associate with access to the Company’s digital files is bound by a strict confidentiality agreement to prevent unauthorized sharing or misuse. These files may only be used for purposes explicitly authorized by the Company and in alignment with its objectives and policies.

In the event of any unlawful procurement, unauthorized sharing, or misuse of such files, the Company reserves the right to initiate appropriate legal proceedings for the redressal.

LIMITED LICENSE
The Company grants you limited, non-exclusive, non-transferable, non-sublicensable license to access, and make personal and non-commercial use of the Site. All rights not expressly granted to you in these Terms of Use, are reserved and retained by the Site and its affiliates.

By submitting custom designs or artwork, you warrant that you own the intellectual property rights or have the necessary permissions. The Mural Story will not be held liable for any copyright infringement claims arising from the use of submitted content.

6. Limitation of Liability

6.1. The Mural Story shall not be liable for any indirect, incidental, special, or consequential damages arising out of your use of the Website or products, including but not limited to:

  • Installation issues or damages caused during installation.
  • Delays in delivery due to unforeseen circumstances.

6.2. In no event shall our liability exceed the amount paid by you for the wallpaper in question.

8. Governing Law and Dispute Resolution

If dispute remains unresolved after 30 days:

- Exclusive jurisdiction: Courts in Gurgaon, Haryana
- Governing law: Laws of India
- Notice period: 30 days before initiating legal proceedings

8.2.4. Consumer Disputes

- Online dispute resolution through Government platforms
